Canada - Shopper's Voice Contest (the "Contest")

 

No Purchase Necessary To Enter Or Win
CONTEST OPEN ONLY TO CANADIAN RESIDENTS (EXCLUDING RESIDENTS OF NORTHWEST TERRITORIES, NUNAVUT AND YUKON) WHO HAVE REACHED THE AGE OF MAJORITY.

 

1. Contest Period: Contest Period begins June 1, 2008 at 12:00:01 AM (ET) and ends on December 31, 2008 at 11:59 PM (ET).

2. Sponsor: Sponsor is ICOM Information & Communications L.P. a/k/a Shopper's Voice, 41 Metropolitan Road, Toronto, Ontario, Canada M1R 2T5.

3. How to Enter: Entries for the grand prize and second prize drawings must be received and/or postmarked by December 31, 2008. In addition, the first 200 mail-in entries received per province are eligible to be entered in a single early bird prize draw. Limit of one entry per person, per household. You may enter the Contest using only one of the following methods:

A) Access www.Shoppers-Voice.com/canada to participate in the Shopper's Voice online survey and type your name, street address, city, province, email address and click on "yes or no" after the "permission" statement and click on "Next" in order to be entered into the Contest.

Or,

B) Fill out your name, street address, city and province on the survey mailed to your household and mail it to Shopper's Voice in the envelope provided in order to be entered into the Contest. No mechanical reproductions will be accepted. Entrant addresses must include street address;

4. Eligibility: Open only to Canadian residents (excluding residents of Northwest Territories, Nunavut, and Yukon) who have reached the age of majority who are located within Canada when they enter, except employees of Sponsor, its parent organizations, affiliates, subsidiaries, promotion agencies, persons engaged in the development, production or distribution of Contest materials, and agents/representatives thereof, and members of their immediate families (spouses and parents, children and siblings and their spouses) and persons living in the same households of such individuals, whether related or not.

5. Prizes and Odds: One (1) grand prize winner will receive CDN $5,000.00. Ten (10) second place winners will each receive CDN $100.00. One (1) early bird winner will receive CDN $500.00. (Total Value of all prizes is CDN $6,500.00). Chance of winning early bird prize is 1 in 2000 for entrants who are eligible for draw; eligibility for early bird draw depends on when your mail-in entry is received relative to others in your province. Odds of winning other prizes depend on number of eligible entries received. Prizes are non-transferable and must be accepted as awarded.

6. Winner Selection: All winners will be selected by Sponsor at its office in random drawings from all eligible entries received. Early bird, grand prize and second prize winners will all be selected on or about January 26, 2009. Early bird winner and early bird entrants not selected as the early bird winner remain in grand prize and second prize pools. Decisions of the judges are final. The selected winner will be notified by email and/or overnight mail or courier, and will be required to correctly answer an unaided, time-limited, mathematical skill-testing question and complete and return, within a specified time, a declaration of eligibility and liability/publicity release. If prize notification is returned as undeliverable or if required documents are not timely returned, winner will be disqualified, and prize will be forfeited and awarded to an alternate by random drawing from remaining eligible entries.

7. General: Sponsor reserves the right to use the name, city of residence, comments, likeness and /or photographs of the winners without compensation, in any advertising and publicity in relation to the Contest. The Contest is subject to all relevant laws.

Sponsor will not be responsible for late, lost, stolen, misdirected, illegible, incomplete, falsified, postage-due mail or destroyed entries and all such entries are void. Sponsor will not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions. Entry materials/data that have been tampered with or altered are void. Entry by means of automated or robotic entry devices is prohibited. All entries become the property of Sponsor and will not be returned.

By entering this Contest, you acknowledge having read these rules and agree to be bound by them and the decisions of Sponsor and the independent Contest organization, which shall be final and binding on all entrants. Entry into the Contest constitutes agreement to be bound by the Official Contest Rules.
For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools des courses et des jeux ("RACJ") for a ruling. For Québec residents, any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.

Subject to the jurisdiction in Québec of the Québec RACJ, Sponsor reserves the right to substitute a prize with one of equal or greater value, to cancel, terminate or suspend the Contest and to amend the Contest without prior notice at any time and for any reason.

8. Winners' List: The names of the winners will be posted on the Shopper's Voice website once the winners have been finally determined. A paper copy of the winners list may be obtained by writing to: Shopper's Voice Fall 2008 Contest Winners, 41 Metropolitan Road, Toronto, Ontario, Canada M1R 2T5 after January 26, 2009 until May 29, 2009.

Shopper’s Voice 2008 Refer a Friend Sweepstakes

OFFICIAL RULES - NO PURCHASE NECESSARY

 

1) SWEEPSTAKES PERIOD. Sweepstakes begins March 1, 2008 at 12:01 AM (EST) and ends on December 31, 2008 at 11:59 PM (EST).

2) HOW TO ENTER: To be entered into the Sweepstakes for a chance to win $1,000 cash, simply refer a friend to Shopper’s Voice using the Shopper’s Voice Refer a Friend Online Form link by 11:59 PM on December 31, 2008. You will receive one entry for each friend who becomes a “New Member”. A New Member is someone whose valid email address has been provided by you, who is not a current member of Shopper’s Voice on the date of your referral, and who becomes a Shopper’s Voice member by 11:59 PM on December 31, 2008. Entries will only be awarded for valid email addresses submitted. Alternate means of entry: You can also enter online by clicking here, typing your name, email address and street address (no P.O. Box numbers, please), and clicking “submit”, No more than one (1) alternate online entry per day.

Entrants should only provide the email addresses of those friends who have consented to being emailed. Entries will be awarded only for valid email addresses submitted. Each time a Current Member refers a friend, Shopper’s Voice will send an email to that person informing him/her of the benefits of Shopper’s Voice membership. Shopper’s Voice will only use the email addresses of referred friend(s) for the purpose of sending an email about Shopper’s Voice membership benefits to the friend until he/she becomes a member.

3) ELIGIBILITY: Open to members of Shopper’s Voice who are legal residents of Canada (except Northwest Territories, Yukon and Nunavut) and the 50 United States and Washington D.C, who are 18 years of age or older, except persons who during any portion of the Sweepstakes Period are employees of Sponsor, its parent organizations, affiliates, subsidiaries, promotion agencies, persons engaged in the development, production or distribution of Sweepstakes information or materials, and agents/representatives thereof, and members of their immediate families (spouses and parents, children and siblings and their spouses) and persons living in the same households of such individuals, whether related or not.

4) PRIZES: One (1) prize of US$ 1,000. Total value of all prizes US$1,000.00. Odds of winning a prize depend on number of eligible entries received for the applicable prize pool. All prizes will be awarded. Prizes will be checks payable to winners. Prizes are non-transferable. Limit one prize per entrant. Federal, state, provincial, local and any other applicable taxes in an eligible jurisdiction in connection with any prize are the sole responsibility of the applicable winner. No substitution or transfer of prizes permitted. Allow two (2) to three (3) weeks after verification of winner status and execution of required releases (where lawful) for the receipt of prize by mail.

5) PRIZE DRAWING: Winner will be selected in random drawings from all eligible entries received by Sponsor at its office in Toronto, Ontario, Canada on or about January 30, 2009. Decisions of the judges are final. Potential winner will be notified by email within 5 business days of drawing, and will be required to complete and return, within 14 days, an affidavit of eligibility (including disclosure of tax identification number if required by law), a liability release and, where lawful, a publicity release. If potential winner is a resident of Canada, he/she must correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered online or offline in order to be declared a winner. If Sponsor is unable to contact potential winner by email, or if potential winner fails to respond to the prize notification (and, in the case of a resident of Canada, the skill-testing question) within 14 days of issuance of notification, or if any potential winner fails to comply with any of the requirements, winner will be disqualified and prize will be forfeited, and prize will be awarded to an alternate winner selected by random drawing conducted by the judges from remaining eligible entries.

6) Conditions Of Participation: Void in Northwest Territories, Yukon, Nunavut; Void where prohibited. Sweepstakes is subject to all relevant laws. By participating, all entrants agree: a) to be bound by these Official Rules, and the decisions of the judges, Sponsor and its agents and designees in all matters relating to the Sweepstakes, which are final in all respects; b) that Sponsor, prize providers, promotion agencies and their respective parents, subsidiaries, affiliates, directors, officers, employees, shareholders, representatives and agents (collectively, Released Parties) will have no liability whatsoever for any injury, loss, harm, damage, cost and/or expense arising from or in connection with participation in the Sweepstakes, and the acceptance and use of the prize or any portion thereof, including, without limitation, any personal injury or death; (c) that the Released Parties have made no warranty, representation or guaranty, expressed or implied, in fact or in law, relative to the prizes or any portion thereof; d) even if abbreviated Official Rules or Frequently Asked Questions (FAQs) are available, that entrants will rely solely on these complete Official Rules; e) the e-mail messages Sponsor sends to Current Members’ lists of referred friends will contain a unique URL that, among other things, allows Sponsor to track the number of eligible entries credited to that Current Member; f) entries and entry and survey data submitted become the property of Shopper’s Voice; and g) entrant data will be collected and used in accordance with the Shopper’s Voice Privacy Policy stated at www.shoppers-voice.com (click on Privacy Policy), which may be modified from time to time, without notice. Acceptance of any prize will constitute winner’s agreement to the use of his/her name, picture/likeness (recorded via any media), and city and state/province of residence for advertising and promotional purposes worldwide in any and all media now existing or hereafter created, without limitation, prior approval or further compensation (unless prohibited by law), and to the use of his/her first initial and surname, city and state/province of residence for purposes of providing a list of winners to the public on request. Subject to the jurisdiction in Québec of the Québec Régie des alcools des courses et des jeux (“RACJ”), Sponsor reserves the right in its sole discretion to cancel terminate, modify or suspend the Sweepstakes in its entirety or in part if, for any reason, this Sweepstakes is not capable of running as planned due to printing error, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, and, in such event, will post a notice thereof on the Shopper’s Voice website www.shoppers-voice.com and select the winners from the entries legitimately received prior to such action. Any attempt by any individual, whether or not a Sweepstakes entrant, to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal or civil laws; should such an attempt be made, in addition to disqualifying such individual, Sponsor reserves the right to prosecute such individual to the full extent of the law. Proof of online submission is not considered proof of delivery or receipt. Shopper’s Voice online surveys and sweepstakes associated with those surveys vary; a survey, its associated sweepstakes and the complete rules of such sweepstakes will be available on the Shopper’s Voice website www.shoppers-voice.com (click on Promotion Rules) during the Sweepstakes Period.

7) Disclaimer. Released Parties are not responsible for: a) printing, human or other errors; b) omissions, interruptions, deletions, defects, or delays in operations or transmission; c) theft, destruction or unauthorized access to or alterations of survey or Sweepstakes entry materials; d) communications malfunctions, delays or errors of any kind including but not limited to technical, network, telephone, computer hardware or software malfunctions, or inaccurate transmission of or failure to receive any information; e) failure of the Sweepstakes to be entered on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; f) injury or damage of any kind to any person’s computer arising out of accessing and using any website or the downloading from or printing of any material from a website; or g) unintelligible, illegible or otherwise unclear entries or incomplete entries.

8. Dispute Resolution: Each entrant residing in the United States agrees: (a) any and all disputes, claims and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Buffalo, New York; (b) any and all claims, judgments and awards shall be limited to actual out-of-pockets costs incurred, but in no event shall such damages include attorney’s fees; (c) not to seek or be permitted to obtain awards for, and each entrant hereby waives all rights to punitive, incidental or consequential damages, or any other damages other than out-of-pocket expenses; (d) not to claim or accept any damages subject to being multiplied or otherwise increased; and (e) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, and the rights and obligations of Sweepstakes entrants and the Sponsor in connection with the Sweepstakes shall be governed by and construed under the laws of the State of New York without reference to conflict of laws. Residents of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. For Québec residents, any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.

9) WINNER LIST: The winner of this Sweepstakes will be posted on or about March 1, 2009 on the Shopper’s Voice web site. Winner will be identified by first name initial, complete surname, city, and state/province of residence. Residents of Canada: The name of the winner may also be obtained by sending a request with a self-addressed stamped envelope to: Shoppers Voice 2008 Refer a Friend Sweepstakes Winner, 41 Metropolitan Road, Toronto, Ontario, Canada M1R 2T5 after March 1, 2008 until June 30, 2009. Residents of the United States: The name of the winners may also be obtained by sending a request with a self-addressed stamped envelope to: Shoppers Voice 2008 Refer a Friend Sweepstakes Winner, 1200 William Street, Box 1382, Buffalo, New York 14240-1382 after March 1, 2008 until June 30, 2009.

Online early bird entry deadline is 11:59 PM (EDT), September 22, 2008.

9.  Name Removal:  Shopper’s Voice maintains a name removal system.  If you do not wish Shopper’s Voice to mail further skill contest or sweepstakes materials that are addressed to you, you may send a request that Shopper’s Voice not mail such materials to you.  Mail the request to: Shopper’s Voice, 1200 William Street, Box 1382, Buffalo, New York 14240-1382.
